Terms and Conditions – Repform

1. Provider, scope and customers

These Terms and Conditions apply to all orders placed through the online shop repform.ch. The provider and contracting party is Mercury International GmbH, Sinserstrasse 65, 6330 Cham, Switzerland, UID CHE-277.689.874 (hereinafter “Repform”, “we” or “us”). Contact: hello@mercuryinternational.ch. The shop is intended for consumers with a delivery address in Switzerland. Deviating terms apply only if we have expressly agreed to them in writing.

2. Offers and product information

Product presentations, images and descriptions are provided for information and generally do not constitute a binding offer. Minor, reasonable variations in colour, texture, shape or packaging remain reserved where caused by technical, manufacturing or display-related factors and where they do not materially impair the agreed characteristics. Dimensions, materials, care and safety information on the product page must be observed. Availability may change before an order is completed.

3. Ordering process, correction of entries and conclusion of contract

The customer places products in the cart, enters the required contact, delivery and payment details at checkout, and can review and correct all information before submitting the order. By activating the final button clearly marked as creating an obligation to pay, the customer submits a binding order. The contract is concluded when we expressly accept the order by email or dispatch the goods. An automatic acknowledgement initially only records receipt of the order unless it is expressly designated as acceptance.

4. Rejection and cancellation by Repform

We may reject or cancel an order for objective reasons, particularly unavailability, obvious pricing or product errors, failed payment, suspected fraud, clearly abusive orders or an undeliverable address. Payments already made will in such cases be refunded using the original payment method. Further mandatory claims remain reserved.

5. Prices, VAT and shipping costs

All prices are stated in Swiss francs (CHF) and include statutory Swiss VAT where due. Any additional shipping costs are clearly displayed with the product offer, in the cart or, at the latest, before the order is submitted. No undisclosed mandatory surcharges apply. Prices may change until the order is placed; the price displayed when the order is submitted is decisive.

6. Payment methods and due date

Payment methods available at checkout may include credit and debit cards through Shopify Payments and, where enabled, TWINT. The purchase price is due when the contract is concluded. Payments are processed by the payment provider shown and are additionally subject to that provider’s terms. If a payment fails or is charged back, we may withhold delivery until full payment has been received.

7. Delivery, delivery area and delivery time

We deliver exclusively to delivery addresses in Switzerland. Delivery times are target times unless expressly guaranteed as binding. Delivery time begins once payment has been authorised and the order has been processed. Partial deliveries are permitted if reasonable for the customer and if they do not result in additional shipping costs. We will inform you without undue delay of significant delays or unavailability.

8. Cooperation, delivery and undeliverable shipments

Customers are responsible for complete and correct address and contact details and for accepting delivery. If a shipment is returned because of an incorrect address, refusal of delivery or failure to collect, the actual additional shipping costs may be charged where the customer is responsible for the failed delivery. Mandatory rights remain reserved.

9. Transfer of risk and retention of title

The risk of accidental loss or accidental deterioration passes when the goods are handed over to the customer or an authorised recipient. The goods remain our property until paid for in full, to the extent permitted by law.

10. Inspection of delivery and transport damage

Customers are requested to inspect the delivery promptly for completeness, visible damage and incorrect items. Transport damage should, where possible, be reported within 48 hours with the order number and photographs of the goods and packaging so that claims against the carrier can be preserved. This request is not an exclusion period and does not limit statutory rights relating to defects.

11. Defects and statutory warranty

The statutory warranty provisions of the Swiss Code of Obligations apply, in particular Articles 197 et seq., insofar as permissibly specified below. Defects must be reported to hello@mercuryinternational.ch without undue delay after discovery and clearly described. We may inspect the goods or request their return. Where a defect is justified, customers are entitled to the statutory remedies. To the extent legally permissible and reasonable for the customer, Repform may initially offer a free replacement or repair; if this is not successful within a reasonable period, a price reduction or rescission remains possible subject to the statutory requirements. A voucher will only be used instead of a monetary refund owed with the customer’s consent.

12. No general right of withdrawal or return

Under Swiss law, ordinary online purchases of goods generally have no general statutory right of withdrawal. Repform currently offers no voluntary right to return or exchange non-defective goods unless otherwise stated on the product page or in an individual commitment. Statutory rights in cases of defects, incorrect deliveries or non-contractual performance remain fully unaffected. Details are set out in the Returns and Refund Policy.

13. Product safety and intended use

Products must be used only in accordance with the product description and all warnings, care and use instructions. Fitness, Pilates and mobility accessories must be inspected before each use for wear, cracks, loose parts or other damage and must no longer be used where there is a safety risk. Resistance products must be used in a controlled manner and must not be stretched towards the face. Products not expressly designated as children’s toys must be kept away from small children. These instructions do not limit mandatory product liability.

14. Liability

Repform has unlimited liability for damage caused intentionally or through gross negligence and in all cases of mandatory statutory liability, in particular under product liability law. For slight negligence, liability is limited, to the extent permitted by law, to foreseeable, direct damage typical for the contract. Liability for indirect or consequential loss or loss of profit is excluded to the extent permitted by law. Exclusions of liability do not apply insofar as they concern life, physical integrity or mandatory consumer rights.

15. Customer accounts and access credentials

When using a customer account, access credentials must be kept confidential. Suspicious or unauthorised access must be reported to us immediately. We may temporarily suspend accounts where there is a specific suspicion of misuse or a security risk.

16. Vouchers and discount codes

Vouchers and discount codes apply subject to the conditions communicated when issued. Unless otherwise stated, they cannot be combined, redeemed for cash or applied after an order has been completed. Statutory monetary refund claims are not converted into vouchers.

17. Data protection

Personal data is processed in accordance with our Privacy Policy and applicable Swiss data protection law. The Privacy Policy is available in the shop footer.

18. Electronic communication

Contract-related communications, particularly order, shipping and security information, are sent to the email address provided with the order. Marketing communications are sent only in accordance with applicable rules and may be unsubscribed from at any time.

19. Changes to these Terms

We may amend these Terms for future orders. The version published when an order is submitted applies to that order. Later amendments do not apply retroactively to contracts already concluded.

20. Severability

If any provision of these Terms is wholly or partly invalid, the remaining provisions continue to apply. The mandatory statutory rule takes the place of the invalid provision. No reduction preserving validity to the customer’s disadvantage is intended.

21. Governing law and jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory places of jurisdiction apply to consumers. In all other cases, Cham, Canton of Zug, is the place of jurisdiction to the extent permitted.
